Collections
Collections involve the representation of a party in a lawsuit for the collection of a debt. The variations on this type of litigation include:
- unpaid promissory note
- unpaid credit card
- unpaid services, labor, products or materials
- unpaid wages or overtime
Examples of matters I have handled for plaintiffs are as follows:
- unpaid bills for produce provided to restaurants
- credit card collection
- student loan collection
- wages owed a former employee
- promissory notes for unpaid loans or sale of a business
- construction work that was not paid
- insurance premiums not paid
- warehouse storage not paid
- furniture imported from China
- unpaid tax services
Sister-State Judgments
California courts accept and enforce judgments obtained in other states. A certified copy of the sister-state judgment, with an application, is filed n the county where the debtor is located. Upon filing these materials and serving the debtor, the judgment becomes a California judgment entitled to collection under the laws of this state.
I have collected sister-state judgments from Ohio, Massachusetts, Minnesota and numerous other states.
Collections Defense
I have defended clients sued for the alleged failure to pay a debt. The common defenses are failure to provide appropriate services; the running of the statute of the limitations on the debt; the late filing of a mechanic's lien; and defenses based upon the unique facts of the matter.
