If the other party carried no liability insurance, you have a right to make a UM claim under your own policy, an uninsured motorist claim. The UM claim compensates you for your personal injuries similar to making a claim against the other party. In the event the other party carried low liability insurance limits and your claim exceeds the limits, you have a right to make an underinsured motorist claim under your own policy. The underinsured motorist coverage is available when your coverage exists that of the other party. These are issues an attorney can advise you when handling your personal injury claim.
As a licensed lawyer fresh out of law school, my first legal position was with an insurance company that insured large trucks. I learned a great deal concerning motor vehicles accidents.
